1. Terms and Conditions
The General Terms and Conditions (GTC) govern the relations between HAPPY MILLIONÄR Bosshard, Bahnhofstrasse 4, 6048 Horw, Switzerland and their customers of this online shop. (Mentiones below HAPPY MILLIONÄR) They are an integral part of every contract concluded between HAPPY MILLIONÄR and a customer. Subsidiary agreements, assurances or changes to these terms and conditions must be in writing. These GTC therefore apply to the order and delivery of standard items incl. Custom-made by HAPPY MILLIONÄR.
The separately listed additional information regarding the delivery conditions / shipping costs and terms of payment as well as the statements on data protection and legal notices form an integral part of these terms and conditions and can be adapted to new circumstances at any time.

2. Conclusion of contract
The customer's order is usually online. In exceptional cases, an order can also be made in writing by email or by phone. As soon as HAPPY MILLIONÄR sends the customer an order confirmation via email, the contract is valid.

3. Binding order
Each completed order is binding and will be custom made on customer request. After completion of the order, the customer can no longer make any order changes.

4. Terms of Delivery / Shipping

Orders are usually shipped within 10 - 14 days. HAPPY MILLIONÄR is in no way committed to following a specific timeline. HAPPY MILLIONÄR reserves the right to ship deliveries without any reason for reasons even after expiry of the proposed timeline. In particular supply bottlenecks of the suppliers, holidays and div. Company vacation of the suppliers can lead to extraordinary delays.

Unless otherwise stated, shipping is free worldwide. Any shipping costs will be shown separately on the invoice and will be displayed in detail on our website during the ordering process before the order is placed.

All shipments are sent directly from the headquarters of the Austrian manufacturer. As a rule, we work with DHL. HAPPY MILLIONAER, however, reserves the right to change the shipping partner, resp. the shipping method, without prior notice to change at any time.
For customers outside the EU (Switzerland, England, USA etc.) separate fees, customs fees, etc. may arise. These costs must be fully borne by the customer.
If the goods can be delivered late or not at all due to incorrect indication of the delivery address by the customer, absence of the recipient or problems with the customs clearance, the company HAPPY MILLIONÄR is not liable.
Our estimated delivery times are based on normal circumstances. For no-fault delivery delays, e.g. due to force majeure, bad weather conditions, strikes, traffic jams etc., HAPPY MILLIONÄR is not liable. Such or similar occurrences do not entitle the customer to withdraw from the contract or to claim damages.

5. Pricing / material / change collection 
Until the order confirmation by HAPPY MILLIONÄR or during the period specified in the order confirmation, the prices are binding. The prices for the offered products, which are listed on the day on which the customer places the order, apply. All prices are - unless otherwise agreed - in EURO excl. VAT, respectively exclusive of all taxes and fees in the respective country.
Any price changes due to price increases of suppliers, adjustment of taxes, fees, taxes or shipping costs are reserved.
5.2. Materials: Exclusively original Swarovski crystals, made in Austria are used. The textiles are manufactured in the Austrian manufactory as one-off productions. The textiles are made in Bangladesh.

5.3. HAPPY MILLIONÄR reserves the right to modify its collection and materials at any time without notice. The images shown in the online shop are considered examples and are not binding. The ordered items differ from the pictures shown.

6. Terms of payment
The orders in the online shop are to be paid by credit card and / or PayPal. All payments by credit card will be charged immediately.
As a rule, prepayments by credit card or PayPal apply to all orders. The ordered goods will be delivered only after receipt of payment. In exceptional cases, the payment by arrangement by invoice in each case possible. In this case, however, the terms and conditions of HAPPY MILLIONÄR apply.
In the event of late payment, HAPPY MILLIONÄR reserves the right to withhold further deliveries to the customer and charge a corresponding default interest of 5%.

7. Complaints / Verification of delivery
The recipient undertakes to check the delivery and its contents immediately upon receipt for completeness and correct condition. Any complaints regarding the quality and completeness of the delivery must be communicated to HAPPY MILLIONÄR immediately, but no later than 24 hours after delivery. Otherwise, the delivery is considered accepted.
The company HAPPY MILLIONÄR is not liable for damages resulting from improper storage of goods after the takeover by the customer or his assistants.

8. Right of withdrawal, right of return, return, exchange, and withdrawal from the contract
Since the offered goods are specially made for the customer special garments there is generally no right right of withdrawal, revocation or exchange. The return or exchange of delivered goods, which were delivered to the customer completely and undamaged is excluded. For the same reasons a contract withdrawal by the customer after receipt of the order is no longer possible. The contract right of withdrawal by the company HAPPY MILLIONÄR according to section 8.1 remains reserved.
Withdrawal: If an article is no longer available for reasons beyond the control of HAPPY MILLIONÄR , HAPPY MILLIONÄR may at any time withdraw from the contract.

9. Privacy
The data necessary for the transaction will be stored and passed on to the contracted company as part of the contract. Incidentally, stored data, with the exception of credit checkpoints, will not be passed on to third-party companies. The data is used for customer care within the company HAPPY MILLIONÄR .
The written by the company HAPPY MILLIONÄR correspondence which serves the contract, can be done electronically. At this point, the security risks such as virus transmission, data corruption, data loss or access by third parties that are not present under the influence of HAPPY MILLIONÄR during data transmission via e-mail are expressly pointed out. Once the order has been placed, the customer allows HAPPY MILLIONÄR to send documents and other data including unencrypted e-mails.

10. Applicable law and jurisdiction
In case of doubt, the German-language version of these terms and conditions always apply. The contracts concluded with the company HAPPY MILLIONÄR are subject to Swiss law, excluding the Vienna Sales Convention (CISG). Jurisdiction is the seat of the company HAPPY MILLIONÄR in Switzerland.​
